Capture Your Light Photography

Terms & Conditions

1. Parties
This agreement is between Capture Your Light Photography, operated by Kathryn Edsall (ABN: 31 595 337 096) (“Photographer”), and the person or entity booking the services (“Client”).

​

2. Services / Scope

• The Photographer agrees to provide photography services as outlined in the booking confirmation.

• Services include scheduled session time, professional editing, and delivery of a specified number of final digital images.

• The Photographer maintains creative control over the session and editing style unless otherwise agreed in writing.

3. Fees, Deposit & Payment

• A non-refundable deposit of 30% is required to confirm and secure your booking.

• The remaining balance is due on or before the session date.

• Payments are accepted via bank transfer or other methods as agreed in writing.

4. Cancellation & Rescheduling

The following cancellation terms apply:

• 7+ days before the session: → Client forfeits the 30% deposit. No additional payment is required.

• 2–6 days before the session: → Client is required to pay 50% of the total session fee.

• Within 48 hours of the session or no-show: → Client is liable for 100% of the total session fee.

• Rescheduling:

• One reschedule is allowed with at least 72 hours' notice, subject to availability.
  Further changes may incur a fee.

• Photographer cancellation:
  In the rare event that the Photographer must cancel due to illness, emergency, or unavoidable circumstances, the Client will be offered a reschedule or full refund, including the deposit.

5. Turnaround & Delivery

• Final, fully edited images will be delivered within 2–3 weeks of the session date.

• Images are delivered via a private Adobe Album to the Client’s preferred email address.

• The album link will remain active for 30 days and can be downloaded and shared as needed.

• After 30 days, the Photographer may archive or delete the album, and retrieval is not guaranteed. Clients are responsible for downloading their images before the link expires.

6. Copyright & Usage

• All images remain the copyright of Capture Your Light Photography / Kathryn Edsall.

• Clients are granted a non-exclusive, non-transferable license to use the delivered images for:

  • Personal use (e.g. social media, prints, personal websites)

  • Small business or professional use, including websites, newsletters, social media, and promotional materials related to the client’s own brand, event, or retreat.

• This license does not include resale, large-scale commercial advertising, or third-party publishing. Any such uses require written approval and separate licensing.

• RAW files will not be delivered under any circumstances unless a specific licensing agreement is made in writing.

7. Portfolio & Marketing Use

• The Photographer may use images for her website, portfolio, social media, and promotional materials.

• If the Client wishes to keep their images private, they must submit a request in writing at the time of booking or delivery. If no request is made, consent for usage is assumed.

8. Client Responsibilities

• Clients are responsible for arriving on time, ensuring appropriate access to locations, and providing accurate session details.

• The Photographer is not responsible for reduced image delivery or missed shots due to late arrival, rushed sessions, or withheld information.

• The Client is responsible for securing any permits or permissions needed for shooting locations unless otherwise agreed.

9. Liability & Limitations

• While all care is taken, the Photographer’s total liability in the case of loss, failure, or damage is limited to the total amount paid by the Client.

• The Photographer is not responsible for delays or failures due to force of nature (e.g. extreme weather, emergencies, equipment failure).

10. Agreement
By booking a session, the Client agrees to these Terms & Conditions.

These terms may be updated at any time and will be supplied upon request.
